In managed migration cases, the consequences of claimants missing deadlines can be severe: legacy benefits will cease, and there may be a gap in entitlement before UC is finally claimed. Additionally, the claimant may miss out altogether on any transitional protection they could receive.
This webinar will focus on the deadlines within the managed migration process and highlight when the DWP can decide to extend the deadline or withdraw the requirement to migrate.
We will look at ways advisers can assist claimants to make requests for extensions or withdrawal/cancellation of their migration notices and what can be done if a claimant has missed a deadline and legacy benefits have ended.
We will also cover the potential judicial review grounds and tactics available for challenging decisions when the deadline clock is ticking (including how to get advice or assistance from CPAG).
Note: the seminar will cover legislation and guidance that applies in Northern Ireland as well as GB. However, when looking at how the rules are being implemented, the seminar will focus on DWP practices and will not cover DfC practices.

Owen Stevens – CPAG Welfare Rights Worker providing advice on all aspects of universal credit.
Lynsey Dalton – CPAG Solicitor with experience of the public law principles relevant to this area.
Method of delivery and timings:
The webinar will run from 1:30pm to 4pm on Tuesday 26th March.
It will be delivered live online, via Zoom, and there will be an opportunity for attendees to ask the speakers questions.

Basic best-practice advice when a client has missed (i) their deadline day and (ii) their final deadline.
Consideration of (the lack of) appeal rights and other remedies where a claimant has had their legacy benefits terminated having missed a deadline.
Other issues which may arise:
- Can an extension of time be granted retrospectively?
- How do backdating requests fit in with missed deadlines?
- Is there anything that can be done to get transitional protection in such cases?
